TERMS and CONDITIONS 

By enrolling your child at Oksigen Theatre, you accept these terms and conditions as an ongoing agreement between you and Oksigen Theatre.

The Agreement is made between the parent/guardian (“Parent”) of each enrolled student (“Student”) and Oksigen Theatre (“Oksigen Theatre “, Registered Charity Number 1165680 ), and it is valid at all times whilst the Student is enrolled on any Oksigen Theatre courses and until such time as written notice by email is given in accordance with these Terms & Conditions.

Oksigen Theatre is run by a committee (“Committee”).

These Terms & Conditions apply to all our classes and any additional products and/or future services offered by Oksigen Theatre.

We may update these Terms & Conditions from time to time. Any changes to these Terms & Conditions require the written consent or approval of Oksigen Theatre.

1. ENROLLING A NEW STUDENT ON AN OKSIGEN THEATRE COURSE

1.1)     To apply for a place for a new Student on a Oksigen Theatre course, the Parent must agree to these Terms & Conditions and complete a Parental Agreement. All Parents must notify Oksigen Theatre of any changes on the Parental Agreement in writing by email.

1.2 )    Each Student’s place is allocated on a “first come, first served” basis.  Potential Students can attend first lesson as a trial lesson and if they decide against enrolling on the course, no charge will apply. 
1.3)     If Oksigen Theatre is unable to accept the Student due to capacity reasons, the Student may, at the Parent’s discretion, be placed on a waiting list.  

1.4)     The fees should be paid termly in full before the half term (i.e. during the first 5 weeks of the term). Alternative ways of payment can be discussed with the Committee by emailing the Treasurer. If after the half term course fees are still outstanding, a Student will be refused further tuition.
1.5)     The fees must be paid by cash or cheque.

1.6)     Oksigen Theatre course fees are reviewed annually and may be increased in January of each year.

1.7)     In the event that a Student is unable to attend an Oksigen Theatre session due to sickness, holiday or a decision by the Parent or Student not to attend, Oksigen Theatre will be unable to refund any payments.
1.8)    Oksigen Theatre may, at its discretion, offer the second child of the same family attending a course at the same time, a sibling discount of up to fifteen (15%) of Course fees.

2. USE OF PERSONAL INFORMATION

2.1)     The personal data (as it is defined in the Data Protection Act 1998) of a Student and/or Parent submitted using the Parental Agreement will be processed by Oksigen Theatre for the purposes of administration.

2.2)     Oksigen Theatre will share this information with external agencies (for example organisations with responsibility for children’s safeguarding) only when required and/or permitted to do so by law.
2.3)     Oksigen Theatre will not disclose personal data to third parties, although Oksigen Theatre may use personal data for their own marketing and business development purposes, including advertising and promoting new products and services of Oksigen Theatre.
2.4)     Oksigen Theatre will from time to time take photographs and film footage of Students during courses and public performances for use in Oksigen Theatre marketing and publicity material. Oksigen Theatre will not make such photographs or film footage of any Student who objects or whose Parent objects. The Parent must state such objections in the Parental Agreement at the time of enrolling on a course.
2.5)     Oksigen Theatre owns all the rights, title and interest in and to its websites, including software, text and media and its trade marks, logos and brand elements. Nothing within these Terms & Conditions affects or licences the ownership of these rights. Any intellectual property created during any course or public performances is owned by Oksigen Theatre.

3. HEALTH AND INJURIES

3.1)     Students participate in Oksigen Theatre activities at their own risk and are obliged to inform Oksigen Theatre and its staff of any existing injuries or medical condition. The Parental Agreement form must have any known medical conditions stated, and Oksigen Theatre must be notified of any changes to such information.
3.2)     Any medication left with a Student during a course must be clearly labelled and the Student should, unless Oksigen Theatre has agreed in writing otherwise, be able to administer it themselves.
3.3)     Students must wear suitable footwear and clothing at all times, including Oksigen Theatre uniform for all courses. Students wearing boots, sandals, crocks, flip-flops or any shoes with high heels will not be allowed to participate in the course activity. The course or session fees will not be refunded in such cases.

3.4)     If a Student is unwell or has an accident requiring emergency treatment, the Parent will be contacted via the emergency contact details provided on the Parental Agreement form. This number must always be contactable whilst the Student is attending the Oksigen Theatre session.
3.5)     Parents are solely responsible for ensuring that the emergency contact details on Oksigen Theatre records are up to date.

4. PERSONAL PROPERTY

4.1)     Students are obliged to take care of their own belongings. Oksigen Theatre can accept no liability for lost or damaged belongings. The use of mobile phones, i-pads and electronic games is not allowed at the time of any courses and sessions.
4.2)     You acknowledge that the maximum aggregate liability of Oksigen Theatre to a Student or Parent under these Terms & Conditions shall not exceed the Oksigen Theatre course fee to which a claim relates.
4.3)      The liability of Oksigen Theatre and that of its staff is restricted to class time only and then only to gross negligence.

5. GENERAL

5.1)     Oksigen Theatre may, at its own discretion, refuse a Student entry to an Oksigen Theatre course or session if it is felt that the Student’s behaviour is unacceptable. The course fees will not be refunded in such case.
5.2)     Oksigen Theatre reserves the right to make changes to the timetable and to the teaching staff from the advertised programme in the event of illness or other circumstances beyond our control.
5.3)     Where a session of an Oksigen Theatre course has to be cancelled by Oksigen Theatre, we will give as much notice as possible. In the event of a last minute session cancellation, you will be notified by email, text message, a call to your mobile phone or through a designated Oksigen Theatre social media site. Parents must ensure that they provide Oksigen Theatre with up-to-date contact details.
5.4)     It is occasionally necessary to change the time and/or venue of an Oksigen Theatre session. This will only be done if absolutely necessary and Oksigen Theatre will do its best to keep class times and locations as similar as possible.
5.5)     All Students must be collected on time after a session.

5.6)    In case of a dispute or complaint from a Parent or a Student, Parents should write to Oksigen Theatre Child Protection Officer, who will take the case to the committee if necessary. If a Parent decides to take their child off the course as a result of such dispute or complaint, the fees for the unused sessions will be refunded only when Child Protection Officer and the Committee found a proved case of a gross negligence on behalf of tutors, helpers or other adults involved in the session.

5.7)     These Terms & Conditions, together with  a Parental Agreement, constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
5.8)     In the event that one or more of the provisions of the Agreement are found to be unlawful or otherwise unenforceable, those provisions shall be deemed severed from the remainder of the Agreement.
5.9)    The Agreement shall be governed by, and construed in accordance with, the laws of England and Wales and any dispute, proceedings or claim shall fall within the jurisdiction of the English courts.
